Trial Mock Objection Responses Handle these items on cross. I don't need to object to on direct: 1. Bailey testifying that he/she is positive it was Morgan's voice that he/she heard in the alley. 2. The White SUV was the only car in the area of the murder scene. Improper Character Evidence Objection: (Mr. T, I was wondering which response is stronger?) Objection your honor, Improper Character Evidence. This Evidence is being offered to show a character trait of violence in Morgan Phillips. This is inadmissible character evidence under Mock Trial Rule 404(B). Objection your honor, Improper Character Evidence. This testimony is being offered to show a violent behavior of the defendant, and will suggest to the jury that Morgan acted in conformity with the violence that Morgan is believed to have shown Mitchell Stevens on the night of his murder. This testimony is inadmissible under Mock Rule Trial 404(B). Unfair Extrapolation Objection Do you remember giving your statement? You had the opportunity to correct and add anything you felt was necessary? Mr./Ms. Bailey, no where in your statement does it say ____________ , True? (If the witness fights me and says they need to see statement, ask this question: May I approach the witness? Mr./Ms. Bailey no where in you statement does it say ______________. Give them 10 seconds for them to look over and then object to unfair extrapolation.) Objection Your Honor, the witness has given an unfair extrapolation. This is an unfair extrapolation because it materially affects the outcome of this case. And under Mock Trial rule 2.3, this witness is not allowed to give unfair extrapolations. I ask that the unfair extrapolation be stricken from the record and the witness be instructed to not give anymore unfair extrapolations.
