Kersten Zielinski Synthesis Essay ENGL 111 MW 5:30 6:50 November 11, 2007 Protecting America through the patriot act On October 26, 2001, a mere 45 days after the September 11 terrorist attacks, the United States welcomed what is probably one of the most controversial pieces of legislation: the USA patriot act . The Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act of 2001 expanded the authority of U.S. law enforcement agencies for the stated purpose of fighting terrorism in the United States and abroad ("USA patriot act "). While opponents of the patriot act object out of fear for a police state, the truth is that it is a tool in the war against terrorism, but it still protects the rights and liberties of American citizens. According to John Ashcroft, the patriot act does three things: One, "it closes the gaping holes in law enforcements ability to collect vital intelligence information on terrorist enterprises. It allows law enforcement to use proven tactics long used in the fight against organized crime and drug dealers"; two, it "updates our anti-terrorism laws to meet the challenges of new technology and new threats"; and finally, with the critical new investigative tools that the patriot act provides, law enforcement can "share information and cooperate better with each other." From prosecutors to intelligence agents, the patriot act "allows law enforcement to ,,connect the dots and uncover terrorist plots before they are launched" ("Prepared Remarks of Attorney General Ashcroft at the Federalist Society Convention" 421). The patriot act was launched in order to help protect America from other attacks like those of 9/11. People feel that Patriot violates their first amendment. Maybe those cynics should spend less time trying to denounce the patriot act and more time doing some homework about Patriot. If they did, they would find that the patriot act doesnt allow the investigation of individuals "solely upon the basis of activities protected by the first amendment to the Constitution of the United States" ("Prepared Remarks of Attorney General Ashcroft at the Federalist Society Convention" 422). Even if the government were allowed to do that, do people really think that our country can afford to investigate every single citizen? The patriot act enhances the tools needed for the United States to wage an effective war against terrorism. Patriot allows the government to use many of the long-standing and wellaccepted tools that the law enforcement uses, including delayed notification, judicially supervised searches, and roving wiretaps, which have been used for a long time in fighting organized crime and drugs right here in our own backyards ("Prepared Remarks of Attorney General Ashcroft at the Federalist Society Convention" 423). These tools still need the probable cause that would be required if it were any other crime. Cynics of the patriot act believe that one only has to "smell something" and the feds can acquire everyones records, including books checked out, credit card purchases, money transfers, and medications (Beard, "Surveillance States" 426). Clay Bennett seems to imply that its preposterous to put the patriot act on as high a pedestal as patriots themselves "Bennett, "Patriots".) Patriots put their lives on the line for the rest of America and show they should be honored, yet by choosing to name this act PATRIOT, Bush seems to be laughing in their faces. Americas heroes should be honored, but naming an act that supposedly allows "sneak-andpeek" tactics demotes them. However, the patriot act , like the patriots of America, is meant to protect us, not throw us to the lions. The patriot act is essential in protecting America from future terrorist attacks. On September 11, 2001, "terrorists attacked our nation thinking our liberties were our weakness, [but] they were wrong," states Ashcroft. "The American people have fulfilled the destiny shaped by our forefathers and founders, and revealed the power of freedom" ("Prepared Remarks of Attorney General Ashcroft at the Federalist Society Convention" 424). After our country was devastated that fateful morning, Bush and Congress, like any good leader would do, rushed to restore confidence and security in Americans. Bush rushed to unite Americans so that the terrorists couldnt achieve their ultimate goal. The patriot act was not passed to harm America or turn it into a police state, it was passed to protect the rights, liberties, and freedoms that we cherish.
