Perlembagaan Malaysia mengandungi 15 Bahagian, 183 Perkara dan 13 Jadual yang menyentuh bidang kuasa eksekutif, legislatif, kehakiman, kedudukan agama Islam, kewarganegaraan, bahasa kebangsaan, kedudukan istimewa orang Melayu, Bumiputera Sabah dan Sarawak dan lain-lain. Sejarah Penggubalan Perlembagaan Malaysia Peristiwa utama Kesatuan Malaya Persekutuan Tanah Melayu 1948 Persekutuan Tanah Melayu 1957 (Kontrak sosial) Konflik antara kaum Melayu & kaum bukan Melayu Peranan Jawatankuasa Kerja Perlembagaan Persekutuan Tanah Melayu (1946) Peranan Suruhanjaya Reid (1956) Peranan UMNO, MCA & MIC Usaha perundingan untuk wujudkan asas perundangan yang sesuai Unsur-unsur Tradisi dalam Perlembagaan Malaysia Unsur-unsur tradisi penting kerana menjadi faktor utama untuk mewujudkan identiti Malaysia dan memupuk persefahaman serta perpaduan. Unsur tradisi juga merupakan satu kontrak sosial yang dipersetujui semasa menggubal Perlembagaan. Unsur-unsur tradisi meliputi Bahasa Kebangsaan, Agama Persekutuan, Kedudukan istimewa orang Melayu dan Bumiputera Sabah dan Sarawak dan Pemerintahan beraja. Perkara-perkara yang menyentuh hubungan etnik ialah: Perkara 8, iaitu persamaan dan hak sama rata dan pengecualian peruntukan ini dalam soal agama, kedudukan istimewa Melayu dan seumpamanya. Perkara 10 (4), iaitu batasan hak kebebasan bersuara daripada menyentuh kedudukan Raja-Raja, Islam, orang Melayu, kewarganegaraan dan seumpamanya. Perkara 38, iaitu kuasa Majlis Raja-Raja menghalang Parlimen membuat undangundang yang menyentuh kedudukan RajaRaja Melayu, orang Melayu, bahasa Melayu dan Islam. Perkara 150 (6a), iaitu kedudukan agama Islam, adat istiadat Melayu dan Bumiputera Sabah dan Sarawak, kewarganegaraan meskipun dalam keadaan darurat. Perkara 152, iaitu kedudukan bahasa Melayu sebagai bahasa Kebangsaan tanpa menafikan hak-hak etnik lain menggunakan bahasa mereka. Perkara 153, iaitu kedudukan istimewa orang Melayu tanpa menafikan kepentingan sah kaum-kaum lain. Bahasa Melayu Perlembagaan Persekutuan 1957 Perkara 152 Fasal 1, bahasa kebangsaan ialah Bahasa Melayu dan hendaklah ditulis dalam apa-apa tulisan sebagaimana yang diperuntukkan dengan undang-undang oleh Parlimen dengan syarat: Tiada sesiapa pun boleh dilarang atau ditahan daripada menggunakan (bagi maksud, lain daripada maksud rasmi) atau daripada mengajar atau belajar apa-apa bahasa lain; dan Tiada apa-apa jua dalam Fasal ini boleh menyentuh hak mana-mana Kerajaan Negeri bagi memelihara dan meneruskan penggunaan dan pengajian bahasa manamana kaum lain dalam Persekutuan. Agama Islam Perkara 3 (1) Agama Islam ialah ugama rasmi bagi Persekutuan; tetapi agamaagama lain boleh diamalkan dengan aman dan damai di mana-mana bahagian Persekutuan. Perkara 11 (3) Tiap-tiap kumpulan agama berhak a)menguruskan hal ehwal agamanya sendiri; b) menubuh dan menyenggara institusiinstitusi bagi maksud agama atau khairat; dan c) memperolehi dan mempunyai harta dan memegang dan mentadbirkannya mengikut undang-undang. Perkara lain yang berkaitan dengan kedudukan Agama Islam ialah: Perkara 11 (4) tentang kebatasan kebebasan agama orang Islam. Perkara 12 (2) peranan Persekutuan dan suatu negeri dalam memajukan pendidikan Islam. Perkara 121 (1A) Mahkamah Tinggi (Negeri-negeri Tanah Melayu, Sabah dan Sarawak) tidak mempunyai bidang kuasa berkenaan dengan apa-apa perkara kuasa dalam bidang mahkamah Syariah. Kedudukan Istimewa Orang Melayu dan Bumiputera Sabah dan Sarawak Disentuh dalam Perkara 153 hak istimewa ini meliputi jawatan dalam perkhidmatan awam, biasiswa, pendidikan, perniagaan dan kemudahan khas lain yang diberikan. Termasuk peruntukan Perkara 86 dan 90 melindungi tanah rizab orang Melayu. Perkara 160 (2) : Orang Melayu ertinya seseorang yang menganuti agama Islam, lazim bercakap bahasa Melayu, menurut adat Melayu dan yang lahir sebelum Hari Merdeka di Persekutuan atau Singapura atau yang lahir sebelum Hari Merdeka dan ibu atau bapanya telah lahir di Persekutuan atau di Singapura, atau pada hari Merdeka berdomisil di Persekutuan atau di Singapura; atau ialah zuriat seseorang yang sedemikian; Manakala Bumiputera di Sabah dan Sarawak ialah: i. Di Sarawak terdiri daripada mana-mana satu kaum asli iaitu Bukitan, Bidayuh, Dusun, Dayak Laut, Dayak Darat, Kadayan, Kalabit, Kayan, Kenyah, Kajang, Lugat, Lisum, Melayu, Melanau, Murut, Penan, Sian, Tagal dan Ukit atau dia berketurunan campuran daripada kaum tersebut; dan ii. Di Sabah pula, anak atau cucu kepada seorang daripada suatu kaum asli Sabah dan dia telah dilahirkan di Sabah. Pemerintahan Beraja Malayan Union menghapuskan kuasa RajaRaja Melayu. Kuasa Raja-Raja Melayu dikembalikan semula apabila Persekutuan Tanah Melayu diperkenalkan. Setelah kemerdekaan, institusi beraja terus dikekalkan dengan konsep raja berperlembagaan selaras dengan sistem demokrasi. Rasional Perkara 153 Semasa proses penggubalan Perlembagaan terdapat semangat persefahaman, akomodatif, berkongsi kuasa dan sedia berkorban yang begitu tinggi dalam kalangan orang Melayu dan bukan Melayu. Semangat adomodatif yang tinggi disebabkan kepentingan masing-masing yang juga dikenali sebagai kontrak sosial Hak istimewa orang Melayu dan Hak kewarganegaraan orang bukan Melayu. Hak istimewa orang Melayu dalam Perkara 153 meliputi jawatan dalam perkhidmatan awam, biasiswa, pendidikan, perniagaan dan kemudahan khas lain. Perkara 153 tidak boleh dipinda, diubah atau dilucutkan tanpa mendapat persetujuan Majlis Raja-Raja Melayu. Perkhidmatan Awam Rasional merizabkan suatu kadar bilangan dalam perkhidmatan persekutuan untuk Bumiputera - pada zaman penjajah dan pada awal kemerdekaan sedikit sangat bilangan yang bekerja dengan kerajaan Cth pada 1968, jumlah Melayu (1,422) dan bukan Melayu (2,497) terutamanya pegawai dalam bidang sains dan profesional. Ekonomi Rasional Jurang pendapatan antara golongan Bumiputera dengan bukan Bumiputera adalah tinggi Cth, RM1 pendapatan bagi orang Melayu berbanding RM2.3 bagi orang Cina dan RM1.8 bagi orang India pada tahun 1970. Pemilikan kekayaan orang Melayu (2.4%) dan bukan Melayu (34%) pada 1970. Pendidikan Orang Melayu tertindas dalam sistem pendidikan British. Pada 1970, terdapat jurang perbezaan golongan profesional antara etnik golongan Bumiputera (4.9% atau 225 orang) dan bukan Bumiputera (84.5% atau 3859 orang). Rasional Perkara 152 Bahasa Melayu bahasa kebangsaan sebagai wadah komunikasi atau bahasa pertuturan umum dan bahasa rasmi negara bagi menyatupadukan rakyat. Tanpa menjejaskan penggunaan bahasa ibunda kaum lain (turut dijamin oleh Perlembangaan Malaysia). Rasional pemilihan bahasa Melayu menjadi lingua franca di Nusantara dan mudah dipelajari. Sebelum Perang Dunia Kedua, bahasa Melayu digunakan secara meluas bagi tujuan rasmi. Pegawai-pegawai Eropah yang memegang lebih 95% jawatan Kumpulan Bahagian 1 perlu mempelajari bahasa Melayu dan lulus untuk ditempatkan di Persekutuan Tanah Melayu. Rasional Perkara 3 Islam telah bertapak lebih 600 tahun lampau dan banyak mempengaruhi cara hidup dan pemikiran orang Melayu. Semasa penjajahan British, Islam tidak pernah diganggu dan urusannya diserahkan kepada Raja-Raja Melayu. Sesuai dengan takrif Melayu dalam Perkara 160. Undang-undang Islam telah diperkenalkan dan diiktiraf sebelum penjajahan British. Kesimpulan Rakyat Malaysia perlu mengambil iktibar daripada pengorbanan yang telah ditunjukkan oleh generasi terdahulu dalam menghayati erti sedia berkorban, berakomodatif dan rela berkongsi kuasa. Kontrak sosial telah diterima sebagai satu kenyataan sejarah dan harus diterima untuk menjaga hubungan etnik di Malaysia. Menghormati hak dan kepentingan setiap golongan etnik seperti mana yang termaktub dalam Perlembagaan Malaysia sangat perlu dihayati bersama agar dapat menghindarkan sebarang konflik yang wujud.
