Margaret wants to reduce somecost for the medicine, so Dr. Geiger gave her some medicine that aren’t helpful for the foot.While Dr, Geiger was on his business trip, other doctors suggested transferring Margaret to otherdisease expert, but Dr. Geiger cancel the transfer process and stopped her prescription because hethinks Margaret doesn’t need it anymore. At the end, Margaret lost her foot and trying to sue Dr.Geiger for malpractice.Issues: Is Dr. Geiger has the responsibility for Kawaauhau’s lost foot?Holding: No. In this case, Dr. Geiger didn’t do anything to try to hurt Margaret’s foot, so he isnot liable for Margaret’s lost foot.Rule: In the case, Dr. Geiger doesn’t have the purpose to hurt Margaret, on the other hand, if Dr.Geiger stopped the medicine for hurting Margaret intentionally, then Dr. Geiger would be liableto Margaret’s lost foot.
