CLASSROOM COURT #10 FINAL REVIEW You should all recall Jeremy Journalist who, fresh out of j-school, is hired to be the outdoor recreation reporter for the Fawnforest Fishwrapper , the only daily newspaper serving Fawnforest, a bucolic town set in the foothills of Northern California. Most of Jeremy’s reporting focuses on fishing and hunting and weekend hiking and canoeing opportunities. Jeremy is currently working on a story on “Fawnforest’s Hidden Swimming Holes.” To research the story he has asked Otto Outdoorsman to take him to some of the best swimming spots in the area. Otto has offered to take Jeremy and staff photographer Sheila Shutterbug in a canoe up Quentin Creek at night onto the private property of the Quentin Quarry Company all the way to the lake that has filed the old Quentin Quarry. Otto has told them that the lake is crowded with swimmers during the day, but must be seen at night to be truly appreciated, when they are likely to catch some students from the local college, Fawnforest CC, students skinny-dipping. Sheila plans to bring a special infrared filter that will enable her to capture images at low light, photographs the skinny-dippers as they swim and dive from the quarry cliffs. Jeremy and Sheila have been trying to convince their editors, Curtis Cautious and Regina Risky to approve this newsgathering. A1. Assess the risk that the students will successfully sue Sheila and Jeremy for intrusion if they go through with their plan. A2. Assess the risk that the students will successfully sue Sheila and Jeremy for intentional infliction of emotional distress. A3. Jeremy wants to include the Quentin Quarry Lake on his list of best swimming holes. Like the other entries he will include directions on the best way to get there, vital information given that the lake is on private property. His editor is concerned that the property owners might sue him for aiding and abetting trespass if they do that and people follow their advice. What should they do? A4. The owners of the quarry go to court seeking an order barring the inclusion of the
