Miranda 1 Michael Miranda CWP 101 Professor McKinnis October 20 th , 2007 Is the Patriot Act unconstitutional? September 11 th , 2001 undoubtedly was a day that changed the world forever. In the timeframe of a few hours American citizens went from living in a bubble of safety and security to a state of shock, fear and uncertainty. In the weeks after these horrific events the American government clearly knew they needed to make some changes to protect America and its citizens. This was how the Patriot Act, acronym for Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act was born. The Patriot act was passed by the House on October 24 th , 2001, passed by Congress on October 25 th , 2001 and signed into law by President George W. Bush on October 26 th , 2001. This is one of the only times that a bill has been passed through House, Congress, and Signed by the president in only three days. This is causing many Americans to question if this law is constitutional and justified or if it is just an angry reaction to the American Government because of the events of September 11 th . First we will examine the pro Patriot Act side of this debate. This is the side I believe is the correct and more justified side of this argument. Just days after September 11 th , 2001 the American government immediately decided that a law needed to be formed and passed to prevent further attacks on American soil. Many government officials and offices believed creating a new act with a strict set of laws to prevent further terrorist attacks was necessary. The Patriot Act was formed with many positive intentions, prevention of further terrorist acts domestically and internationally and dismantling of terrorist cells domestically and internationally were the primary goals of the act

Miranda 2 (Ashcroft). According to the John Ashcroft , a well known politician and supporter of the Patriot Act , the Patriot Act has prevented further terrorist attacks in two ways. First the Patriot Act closes the gaping holes in law enforcement's ability to collect vital intelligence information on terrorist enterprises. It allows law enforcement to use proven tactics long used in the fight against organized crime and drug dealers (Ashcroft). This means that law enforcement has more power and authority to perform operations that will eliminate terrorist uprisings. Second , it updates our anti-terrorism laws to meet the challenges of new technology and new threats (Ashcroft). This means that the current laws are adapted to current technology to help government and law enforcement agencies
