MUSC 108: Class Notes 09/05/07 Conditions Lay out future of the terms Termination of any part of the original agreement if the band breaks up. 1. Reorganization of original participants a. Also want to be able to add participants to the agreement 2. Ethics clause a. Arrests b. Used as an excuse to drop Tom Cruise, but was really because he was making  almost 60% c. Knowingly perform any illegal activities d. Michael Vick – dog fights e. No slander i. Can go to jail, fined for libel 3. Reasonable efforts to perform live, make public appearances. 4. Recording and guest appearances on other labels or other recordings need express  permission from label. 5. Key man clause a. Only can get this if you’re calling the shots. b. Key man: the artist will not talk to or communicate with anyone else, only the key  man (at the label, etc.) c. Can ask that your contract is cancelled if your key man leaves the company. “Howling at the Moon”
