Rev. 473 1918-1919MARRIAGEBYPROXYANDTHECONFLICTOFLAWS473MARRIAGE BY PROXYANDTHECONFLICTOFLAWSITHEquestion whether a marriagemaybe celebratedbyproxyhas been of very little practical importanceinmodern times.Sofar as EnglandandAmerica are concerned no mention is madeof marriagebyproxyinthe books of the nineteenthandtwentiethcenturies.Theonly discussion of the subjectinthe Englishlanguagethathas cometothe notice of the writer is foundinSwin-burne's"Lawof Espousals" which was first publishedinthelatterpartof the seventeenth century.1Thecontinental writers also, whoare more inclinedtodiscuss problems of a purely theoretical naturehave paid little attention tothesubjectinrecent times.2Thelegislation of the present war, however, has giventothe subjectrenewed importance, forinthree of the continental countries -Belgium, France,andItaly-marriagebyproxy has been expresslysanctionedbylaw.Thepresence of somanyAmerican soldiersabroad naturally raises the question whether theymaycontract amarriagebyproxy eitherbyvirtue of the American law orbyvirtueof the law ofthecountryinwhich theymayhappentobe forthetime being. Beforeananswer can be given to these questions thesubject of marriagebyproxymustbeconsideredbothfrom thestandpoint of the internal law oftheprincipal countries concernedandfromtheviewpoint oftheAmerican rules relating totheconflictof laws.Thatmarriagebyproxy was allowedinthe late Roman law andinthe Canon Law isanestablished fact.
