Brennan Degan Disscustion Paper #5 Word Count: 717 Judicial Legislation When an individual becomes a Supreme Court Justice all sorts of benefits become afforded to him. These benefits range from getting to write court briefs to changing legislation. Is it right that judges should be able to make and affect laws with there ruling? Like any good argument there are two side to look at in this situation, one side thinks that judicial legislation is an important part of the government and is afraid our rites will be abused if it is not let to continue, the other say that legislating should be let up to the legislators and congress. The people in favor of judges affecting legislation say that it is a vital checks and balances for the other branches of government. By using tools such as judicial review judges are able to over see the constitutionality of laws. These things are taken into consideration when the judge is appointed as well. People know an expect judges appointed to the Supreme Court to have to make decisions that will change laws. This in
