Degan 1 Brennan Degan Discussion Paper #5 Word Count: 707 Judicial Legislation When an individual becomes a Supreme Court Justice all sorts of benefits become afforded to him. These benefits range from writing court briefs to changing legislation. Is it right that judges should be able to make and affect laws with their ruling? Like any good argument there are two side to look at in this situation; one side thinks that judicial legislation is an important part of the government and is afraid our rights will be abused if it is not continued the other says that legislating should be left up to the legislators and congress. The people in favor of judges affecting legislation say that it is a vital checks and balances for the other branches of government. By using tools such as judicial review, judges are able to over see the constitutionality of laws. These things are taken into consideration when the judge is appointed as well. People know and expect judges appointed to the Supreme Court to have to make decisions that will change laws. Keeping this in mind judges are not nominated
