Case III 1 one thing only, and it was doing its job, but the when truck is used for other stuff than what it is intended for, the truck cannot be blamed. Even though the truck would have been deflective, it’s the employees’ responsibility to make sure the truck is working properly. But maybe we considered the area under construction part of equipment, and then lack of information was given to the truck driver to be aware of the construction. Information or advance warning of the area being under construction, either by memo or verbal, and the most important notice that was not done, was to rope off the area either by barricades or tape, with signage that reads “DO NOT ENTER’, the more information given or posted the better.
