IS3350 LEGAL ISSUES IN INFORMATION SYSTEMSPROJECTPREMIER COLLEGE DOCUMENT RETENTION POLICYMarch 8, 2015POLICY STATEMENTPOLICY STATEMENTPremier College has developed a document Retention Policy to protect and preserve all criticaldocuments as required by state and federal laws. The College is responsible for retaining paperand electronic documents in a safe and secure environment to ensure the basic values ofaccuracy, confidentiality, security, and proper archiving as well as proper document destructiononce documents have served their purpose.This Policy is also for the purpose of aiding employees of the organization understanding theirobligations in retaining electronic documents including e-mail, Web files, sound and movie files,PDF, TIFF, TXT files and documents, Calendars, Computer usage logs, Internet usage logs,Databases, and all Microsoft Office or other formatted fileThis policy is written with considerations for compliance with federal mandates and actsincluding The Sarbanes-Oxley Act, Health Insurance Portability and Accountability Act (HIPPA),The Fair Credit and Accurate Transaction Act (FACTA), Gramm-Leach-Bliley (GLB) and otherfederal, state and local mandates.EFFECTIVE DATEThis Policy is effective as of March 8, 2015, (the “Effective Date”) and applies to all documentscreated after the Effective Date. However, to the extent possible, the Policy will be applied to alldocuments regardless of creation date.LEGAL HOLDA legal hold suspends all document destruction and supersedes all procedures under thisPolicy. The purpose of a legal hold is to preserve and protect appropriate records under specialcircumstances, such as litigation, or when litigation is reasonably anticipated, or a governmentinvestigation. All employees and Board members will be notified by the President of the PremierCollege or his or her designee when a legal hold is required, and will be provided specificinstructions for compliance.If an employee is unsure whether a document has been placed under a legal hold, theemployee should preserve and protect that document and check with the President of PremierCollege.COMPLIANCE2

Failure to comply will subjectthe individual to disciplinary action, up to and including termination of employment or removalfrom the Board, at the Foundation’s sole discretion, and may lead to civil penalties andsanctions and/or criminal prosecution.STORING PROCEDURESThe retention period for each document type is set forth under the column labeled “RetentionPeriod.” All employees and Board members are responsible for ensuring that the records theyhandle, control or create are treated in accordance with this Policy.
