Madison Leibman LEB 323 Journal Entry Arbitration When entering Shepherd of God Assisted Living Home in California one must sign a document, Shepherd of God Assisted Living Agreement, listing out rules and procedures in order to be able to live in the nursing home. In the extensive list of regulations comes an overlooked section that many people are victim to blindly signing, a submission to binding arbitration. Specifically for this nursing home, families sign away the right to take any claim or dispute to a court of law and instead are subject to arbitration. It dictates which court the proceeding will take place in and how the arbitrator will be selected. Not only does it sign away the right for the individual signing the contract to take it to court but also the right for their spouse, heirs, representatives, executors, successors, and assigns to do the same. The arbitration clause will remain in effect even after the termination of the agreement.
