Exercise: Assume for this exercise that the Depression didn’t happen and didn’t play any role in the West Coast Decision Write down three of the most persuasive lines of reasoning o Adkins Majority/West Coast Dissents Minimum wage law for women is unconstitutional because it infringes on the liberty of contract Difference between men and women has come to a vanishing point and if there is a min wage law for women then there must be one for men Right of the worker should be equal to the right of the employer The community at whole should bear the burden of the workers being poor and not the employer himself One should limit the police power of the state, if we give more powers to the police then we are opening the doors for the government to have more widespread power o Adkins Dissent/ West Coast Majority Min wages laws don’t infringe the right to contract because sometimes employers pay more than the min wage regardless Not forcing employers to pay anything but if they hire someone they have to pay a minimum wage Legislating max hours is no different than legislating min wages
