The judges, of both the SC and the inferior courts , shall hold their offices during good behavior, and shall, at stated times, receive for their services, a compensation, which shall not be diminished during their continuance in office. • Jurisdiction of the Federal Courts (Article I I I, Section I I, paragraph 1) o All cases in law and equity arising under the consituton, the laws of the US, and treaties o Cases affecting ambassadors, public ministers, and consuls o Cases of admiralty and maritime jurisdiction o Controversies to which the US is a party o Controversies between two or more states o Controversies between a state and citizens of another state (11 th amendment [1795] removes this if the suit is brought by citizens of another state or by citizens of a foreign nation) o Controversies between citizens of different states o Controversies between citizens of the same state claiming lands under grants of different states o Controversies between a state (or its citizens) and foreign states, citizens, or subjects • Original vs. Appellate Jurisdiction of the SC (Article I I I, Section I I, Paragraph 2) o Original - #’s 2, 5, 6, 9 o Appellate: All others • Marbury v. Madison (1803) o 1800: Jefferson(Dem) replaces Adams (Fed) as Prez. Democrats also win majority of house and senate o Adams and feds in congress appoint 59 loyal Feds to federal jobs: Midnight appointments o Adams’ Sec of state (Marshall) delivers 42, but leaves 17 on desk for new Sec of State (Madison) to deliver. One of those appointments was William Marbury for position of Justice of the peace in the District of Columbia...
