The CNBV it is an organ decentralized of the Secretariat of Estate and Public Credit (SHCP) with technical autonomy and executive powers in the terms of the Law of the National Bank Commission and of Values. The CNBV has for object supervise and regulate in the area of their competence, to the financial institutions, in order to get its stability and correct functioning, as well as support and promote the healthy and balanced development of the financial system in their set, in protection of the interests of the public. Also it will be their object to supervise and to regulate the natural persons and other moral persons, when they realize activities foreseen in the laws relative to the mentioned financial system The fundamental mission of the CNBV is to protect the stability of the Financial Mexican System and to promote its efficiency and enclosing development in benefit of the society. As what for it has numerous powers, emphasizing the related one to the supervision which subjects itself to
4 GE Title or job number 9/8/15 The CNBV possesses a Meeting of Government who determines or recommends that one should proceed to the admonition, suspension or removal and, in its case, incapacitation of the counselors, executives, commissioners, representative trustees, proxies, civil servants, external independent auditors; to agree the administrative or managerial intervention of the entities in order to suspend, to normalize or to solve the operations that put in danger their solvency, stability or liquidity; to impose administrative sanctions for infractions to the laws that there regulate the activities, entities and persons subject to the supervision of the Commission; to authorize the constitution and operation and, in its case, the inscription in the National Record of Values and Intermediaries, of those entities that indicate the laws, among others. The CNBV supervises identities, which go from the private companies belonging to the economic Mexican fabric up to public organizations with financial activities. Recently financial reform that the Federal Executive was issuing to the Deputies' Chamber will give in May authority in order that the CNBV monitors and supervises to the banks and this way to protect the saver and to safeguard to the financial system, providing it with mechanisms that allow it to demand to the banks more liquidity, to suspend partially or totally transfers of resources, payments of dividends or purchases of assets with related parts and it improves the process of bankruptcy of the banks.
