Poly Science Test Review Notes-On Test Marbury v. Madison 1. Marbury goes to Supreme Court to and asks them to issue a Writ of Mandamus claiming SC can issue Writ of M in ANY case based on section 13 of the judiciary act of 1789. 2. John Marshall, now Chief Justice, faced major dilemma because he is fed. 3. Rules Sec 13 unconstitutional 4. He says congress cant add to supreme courts original jurisdiction, but they can on appellate. 5. Significant for 3 reasons 1. The decision was the first time the court overturned an act of Congress on the principle that laws not conforming to the const are null and void. Because of this, the SC began reviewing legislation to ensure it conforms to the const. 2. The decision clearly held that the original jurisdiction of the SC is established on constitutional rather than legislative grounds. 3. The decision proved a very effective instrument to monitor state legislation and actions. Hilton v. U.S. 1796
