Thecase began in 1801 during Thomas Jefferson’s inauguration for being the new president of theUnited States of America. Prior to Jefferson’s time in office president John Adams passed theJudiciary Act of 1801, this act would create new courts, which created new judges, this gave thepresident more power in controlling the courts because the president would appoint the newjudges (Urofsky, 2019). Adams wanted to get as many Federalists into the court as possible tointerrupt Jefferson’s legislative agenda. As the act was passed, 16 new circuit judges wereappointed as well as 42 Justices of Peace. The newly appointed judges and justices had beenapproved by the Senate, their letters were sealed and stamped (Urofsky, 2019).
