09/11/07 Case 3 ZIMZIM, INC. v. COUNTY OF TRENT Background: ZimZim Inc. filed a complaint against the county of Trent because they felt that the awarding of a contract to ARS-Waste Management, Ltd. should have been theirs due to Trent exercising dishonest discretional powers. ZimZim believes that the bid from ARS should not have been accepted because their bid was received after the allotted time. Summary of Facts: Trent County held open bids for company’s services in constructing a waste treatment plant. ZimZim was the first company to submit a sealed bid, which was followed by BFI also submitting a sealed bid. Both of these bids were submitted before 2:00 p.m. that day. ARS was also in the room prior to 2:00 p.m. with a sealed bid ready to be submitted, but the county employee in charge of accepting bids was not currently in the room to accept the bid. ARS’s bid was not received until after the allotted time ended, but the county employee took it anyways. When it came time to open the bids to see who was the lowest bidder, ARS turned out to be the
