Mock Mediation Chasity (mediator): Hello Leo and Katrin. I am Chasity Swift and myself and Jill Carter will be mediating you fine folks. Keep in mind you are both hear by choice and are free to leave or stop the mediation. Leo: yes mam Jill (mediator): Good evening. My name is Jill Pollard and I will be facilitating your mediation process this evening. Before we start, let me give you an overview of the process and how I would like it to go. The major steps we need to go through are: 1) Assessing this conflict together, 2) making sure you are both ready to solve it, 3) negotiating and compromising to meet each other somewhere in the middle, and 4) constructing and implementing an agreement. Katrin: I understand. Jill (mediator): Do either of you have any questions about the overall process? Katrin: not at the moment Leo: No ma'am. Thank you Jill (mediator): Ok, thank you. I hope we can solve the issues today, but please do not be discouraged if we’re unable to make it through the entire process today. We may want to take a couple of days to sleep on it and make sure we do not feel rash in our decisions. Leo: Ok Katrin: ok Jill (mediator): Let me start by asking your names and title (or occupation). Let’s start with Katrin. Please follow with your response, Leo. Katrin: My name is Katrin and I am the owner/manager of the Blue Moon Cafe Leo: My name is Leo and I supply goods to different businesses in the area Jill (mediator): Are there any other disputants who should be involved in this mediation? If so, please state their names. Katrin: None on my part. Leo: None here either Chasity (mediator): Leo would you like to tell us the issues that have brought you here? Jill (mediator): Okay, please briefly state your perception of the problem. Leo, will you start and Katrin follow? Leo: I supplied Ms. Katrin with bottles of vodka and glasses for her martini bar and she has refused to pay me what is owed
Katrin: Leo supplied me with less Vodka then I asked for, the wrong kind, and the wrong kind of glasses. None of it was right. Jill (mediator): Okay, we (the mediators) understand your position. Now, Katrin - what is your view of the issue? What were each of your immediate actions/reactions to the problem? Chasity (mediator): Are there any past or present feelings or situations that may come into play during our negotiation? Katrin: I was very upset that he didn't hold up his part of the deal. I feel cheated. Chasity (mediator): Did you explain your concerns to Leo Leo: She did not reach out to me the next day or even that night of the situation but waited 2 days Jill (mediator): Ok, so I understand that Katrin’s claim/dispute/defense is she was shorted product and supplied with the wrong type. She was very upset. Chasity (mediator): Did you guys happen to sign a contract?
