LEGAL PROFESSION (PUBLICITY) RULES 2001The aim & intenton of the PRto ensure that the service is a mater of quality rather than priceto minimize commercialism in an honorable profession; andto preserve the dignity of the profession.Opponents viewadvertsing is necessary in order to ensure compettveness; andto give access to the quality and price of services.Rule 2- approved informaton that can be disclosed by an A/S-approved informaton means only one or more the following i.e. the name, address,telecommunicaton, business hours of the frm.-The year in which the frm or its predecessor in ttle was established.-The merger of frms if any-Area of practce-Academic and professional qualifcatonsApplicatonRule 3- it states these rules apply to every A/s whether he is practsing as a sole proprietoror as a partner, an employee or a consultant of a frm.Rule 4-Advocate and Solicitornot to publicizeexcept in accordance with these Rules.-It states that no A/s shall publicise his practce or practce of his frm, or permit orallow any of his employees or any persons to publicize that practce, in any mannerexcept in accordance with the Rules-No A/S shall solicit or atempts to solicit professional business in the opinion of theBar Council amounts it to publicity.Rule 5-Publicity within Malaysia-(1) (a) - A/S who publicises his practce or frm within Malaysia shall not do so in amanner likely to diminish public confdence that brings disrepute to the profession.-The manner should not be regarded as being ostentatous, in bad taste, misleading,deceptve, inaccurate, false, sensatonal, intrusive, ofensive or inany other wayunbeftng the dignity of the legal profession.-(2)(a)- A/S shall not claim that he is a specialist or expert in any area of practce.-Shall not make any direct or indirect reference to the number or proporton of casesthat have been successful.-Shall not state anything that would be construed as ofering any inducement to, orimposing any duress, upon any person as a means of obtaining professional businessfor himself or his frm.Downloaded by AZIRAH BINTI AZHAN Unknown ([email protected])lOMoARcPSD|4396206
-A/S should not make any statement relatng to the rates charged by him or his frm’smethod of charging.-A/S not allowed to make any laudatory (congratulatory/ admiring/ complimentary)references to himself or his frm, or directly or indirectly extol the quality of theprofessional services provided by him or his frm.
