ISSUE AND CONCLUSION When the husband is the executor of his wives estate, how is his commission determined? According to N.J.S.A. § 54:34-1 paragraph (e) The Superior Court having jurisdiction in the case, shall determine what is a reasonable compensation. FACTS I received a call from Mr. John Smith stating that his wife and our client, Mrs. Jane Smith passed away about three weeks ago. Mr. Smith stated that he would like our firm’s assistance in probating her will. Mr. Smith would also like to know what his commission will be as Executor of the
