ACF PART 3 2 Agency’s Law and Ethics of Hiring a Diverse Workforce A personnel management system is the “administrative discipline of hiring and developing employees so that they become more valuable to the organization. It includes (1)conducting job analyses, (2) planning personnel needs, and recruitment (3) selecting the right people for the job, (4) orienting and training, (5) determining and managing wages and salaries, (6) providing benefits and incentives, (7) appraising performance, (8) resolving disputes, (9) communicating with employees at all levels.”[ CITATION Per \l 1033 ] The policies and procedures of the personnel management system are guidelines in which employee actions are regulated and customs as to how activities are handled. Procedures are often more specific than policies. The purpose of both personnel policies and procedures are to bring structure and organization to the organization. Making sure that these policies and procedures are clearly and precisely written, documented and updated as well as followed is the job of the human resource department. Some policies are required by law, which an agency is legally responsible for implementing. Such laws include those required by Title VII of the Civil Rights Act of 1964 requiring that companies provide a work environment for employees that is free from sexual harassment, some companies have established a zero tolerance policy. The Equal Employment Opportunity Act forbids companies from discriminating against present and potential employees based on race, sex, religion, country of origin and color. To enforce these guidelines and procedures is role of the management personnel staff. Laws Affecting the Agency There are a number of laws in relation to the workplace, laws in regards to pay, benefits, retirement, hiring, discrimination and safety. “The United States Department of Labor (DOL), administers and enforces more than 180 federal laws.”[ CITATION Sum \l 1033 ] Such laws are

The Lesbian, Gay Men, Bisexual and Transgender (LGBT) people and discrimination have become a huge issue to not only the President of the United States but also to employers. The EEOC has “held that discrimination against an individual because that person is transgender (also known as ender identity discrimination) is discrimination because of sex and therefore is covered under the Title VII of the Civil Rights Act of 1964.”[ CITATION EEO \l 1033 ] The Civil Service Reform Act of 1978 (CSRA) protects federal government applicants and employees from discrimination in personnel actions or conduct that does not affect their performance, which includes sexual orientation and gender identity.
