Pursuant to Section 3(1) of the Partnership Act 1961, a partnership is defined as a relation which subsists
between persons carrying on a business with a view of profit.
There are 3 essential ingredients for a partnership namely:
 A business
 Carried on in a common and
 With a view of profit
Pursuant to section 4(c)(iii) of the Partnerships act 1961, a person being the widow or a child of a
deceased partner, and receiving by way of annuity a portion of the profits made in the business in which
the deceased person was a partner, is not, by reason only of such receipt, a partner in the business or
liable as such.
