Have courts have gone too far in protecting the rights of despicable individuals and groups who engage in hate speech PROS:- The courts have laid down decisions in the past that have upheld the ideals that surround the first amendment and the idea that free speech is protected by the first amendment of the US constitution. Perhaps the most famous decision to up hold the idea of free speech is Texas v. Johnson when Johnson was convicted of burning the flag as a direct act against the country and the “desecration of a venerated object” which violated a Texas law. The conviction was overturned by the court of appeals and upheld by the Supreme Court under the idea that it was a pure expression against the actions of President Reagan and some of his actions and was protected under the 1

CONS-The courts have took in upon themselves to overrule the 1 st amendment to the constitution if what is said is proven to be a clear and present danger to the country, is brought about in a time of war, or is some form of slander towards another free citizen. The courts have allowed the 1 st amendment to grant protect citizens but have not gone to the point of allowing despicable individuals to partake in group hate speech. The 1 st amendment doesnt advocate hate crimes or slander of groups of people and anything seen as a danger to a group of people is dealt with and not allowed....
