5/7/2009 Political Science Notes Problem of Constitutionalism o Publius is arguing that a slight violation of separation of powers is necessary to preserve the principle in the long run o Checks and Balances saves or maintains the Separation of Powers A sense of constitutional duty – duty to follow the rules of the constitution A sense of self-interest – a connection b/w personal self-interest and institutional interest o Judicial Review The power of certain courts to declare acts of the legislature and executive to be unconstitutional and hence null and void Mechanism to keep government within Constitutional limits Anti-federalists opposed to They felt that it was fundamentally undemocratic Thought that it was a will in the community independent of the majority The key to understanding Publius’ support of judicial review – Will of the people = Constitution Written constitution protects the people from government; judicial review enforces constitution
