Tim Woodward – 108303348 10/31/06 – Case Briefs CCJS 230 – Section 0201 People v. Olivo 420 N.E. 2d 40 (N.Y. 1981) Facts of the Case: Three people: Ronald Olivo, Stefan Gasparik, and George Spatzier, were convicted of petit larceny by local courts, the New York Supreme Court, and the New York Court of Appeals. Olivo attempted to steal wrenches by concealing them in his clothes and under his jacket before he was stopped and apprehended by store security guards before he could escape the store. Gasparik removed the price tag and sensor device from a leather jacket, concealed them in the pocket of another jacket, and left his own jacket in the store while he attempted to exit the store wearing the leather jacket. He was also stopped by security guards before exiting the shop. Spatzier attempted to shoplift a book from a bookstore by hiding it in his attaché case. He got in an altercation with the store owner and struck the owner with the case which caused to book to fall out. Issue Presented:
