ELVIS PRIESTLY AND EP, INC., PLAINTIFF’S MOTION TO COMPEL COMPLIANCE Plaintiff, by and through undersigned counsel, moves this court for an order to compel the Defendant to adequately respond to discovery as follows: 1. Plaintiff’s Request for Production was served on Defendant on January 30, 2008. 2. Plaintiff’s Interrogatory was served in Defendant on January 30, 2008. 3. Defendant’s Answer to Plaintiff’s Request for Production was submitted March 3, 2008. 4. Defendant’s Answer to Plaintiff’s First Set of Interrogatories was submitted March 3, 2008. 5. Defendant’s answers to both of Plaintiff’s requests were received three days late. 6. Defendant’s Answer to Plaintiff’s Request for Production contained the following defects: A. Objection to Request 2 is invalid. B. Objection to Request 3 is invalid as admissibility of the evidence is irrelevant.
