Despite not being a fundamental right under the Constitution, there is a requirementunder the equal protection clause of the 14thamendment for not denying equal access toschooling whenever a state establishes a public school system. The Constitution does providefor non-discrimination, requiring every child to get equal educational opportunity regardlessof their sex, race, ethnicity and ethnic background and religion. The education system in theUS may be well established, but there is a major challenge; inability to meet the requirementsof the modern society that is constantly evolving. There is large inequality in the Americaneducational outcome, a problem which only exists because a lot of people look at educationas a way of improving their social status and enhancing the quality of their lives (Dominguez,1).Despite non-discrimination being deeply rooted in many constitutions all over theworld and in international treaties and conventions, the problem of unequal access toeducation is rampant. A study by Boundless Sociology (n.d.) found that education accesschanges by geographic location and other aspects like gender, class and race. With freeeducation in public schools all the way to 12thgrade, post-secondary college education in theUnited States comes at a price. Those that cannot afford the expenses tend to have unequalaccess.
