Skilling vs. United States Facts: Enron Corporation crashed into bankruptcy in 2001 and its stock value came crashing down. After investigation, we now realize there was a conspiracy. The company did many things to overstate their financial well-being such as altering financial statements to make them look more attractive to investors and lenders, disguising expenses in the form of revenue, assets were really loans. It was just four months before, that the CEO, Jeffrey Skilling, resigned four months before the downfall. He was he was convicted of conspiracy to commit honest services wire fraud, securities fraud, and money or property wire fraud. There is a law specifying that fraud can be committed by denying someone the ‘intangible right” to one’s “honest services”. Issue: 1) Did Skilling use deception for private gain and thus violate the honest services law? 2) “Do we have confidence that the jury’s verdict was “induced only by evidence and
