INTRODUCTION The need to earn more and motivate employees had led to many corporation introduce tipping policies. This in turn has made these corporations reduce their costs on wages and salaries. However if not properly implemented the policies may depict a fraudulent activity if the tip is not honored to the employee and thus legal prosecutions may follow. This topic is important to me because in the future I plan to work in the service industry. I want to trust what the company published formally or informally to be true. I would want to be treated in accordance with the company By-laws, be honored what is due to me at the end of each day and ensuring that the customers’ interests are met. LEGISLATION Cal Lab Code § 351 § 351. No employer or agent shall collect, take, or receive any gratuity or a part thereof that is paid, given to, or left for an employee by a patron, or deduct any amount from wages due an employee on account of a gratuity, or require an employee to credit the amount, or any part thereof, of a gratuity against and as a part of the wages due the employee from the employer.
