Understand the difference between health law and public health law.Health Law vs. Public Health LawDefining health law and public health law depends on whom you ask.Health lawis concerned with the legal aspects of promoting the quality, organized delivery,cost effective, access to health care, while protecting the human rights of thosewho are provided care within the health care system.“Public health law is thestudy of the legal powers and duties of the state to assure the conditions ofpeople to be healthy (e.g., to identify, prevent, and ameliorate risks to health inthe population) and the limitations on the power of the state to constrain theautonomy, privacy, liberty, proprietary, or other legally protected interests ofindividuals for the protection or promotion of community health.”1James Tobeysaid, that “[Public health law] should not be confused with medical jurisprudence,which is concerned only in the legal aspects of the application of medical andsurgical knowledge to individuals. . . .[P]ublic health is not a branch of medicine,but a science in itself, to which, however, preventive medicine is an importantcontributor.Public health law is that branch of jurisprudence, which treats of theapplication of common and statutory law to the principles of hygiene andsanitation science.”2Perhaps Lawrence Gostin said it best, “ Public health law isthe study of the legal powers and duties of the state, in collaboration with itspartners (e.g., health care, business, the community, the media, and academe),to ensure the conditions for the people to be healthy (to identify, prevent, andameliorate risks to health in the population), and of the limitations on the power ofthe state to constrain for the common good the autonomy, privacy, liberty,propriety, and other legally protected interests of individuals.The prime objectiveof public health law is to pursue the highest possible level of physical and mentalhealth in the population, consistent with the values of social justice.”3Socialjustice and the common good refer to the ethical and moral issues of health care.
