LGST 101 Session 23: Damages and Remedies REVEW: Damages – diff between monetary damages and “extraordinary relief” SPECIFIC PERFORMANCE*** (important term) UCC – remedies provided by code should be liberally administered to the end that aggrieved party may be put in as good a position as if other party had fully performed 1) Restitution Interest 2) Reliance interest 3) Expectation interest THESE TERMS WILL BE TESTED ON THE EXAM!!!!!! Restitution interest – getting something that you had already given when the contract is breached….ex: down payment Reliance interest – damages received because you relied on the contract and did other things with that assumption Expectation interest – damages received as if contract had gone through, what place would the person be in HAWKINS v MCGEE The hairy hand case.
