LGST 101 Session 11 – International Law What is International Law? o 1. “A rule…That has been accepted as such by the international community” Comparative Law vs. International Law Comparative law = looking at two or more national legal systems and comparing them o Includes: Customary International Law “We’ve always done it this way” International treaties and agreements General principles common to major legal systems Big divide: Public vs. Private o Public international Law Involves relationships between countries and applies “norms regarded as binding on all members of the international community” How enforced? o Politics/processes Ex: division of oceanic resources, human rights, laws of war, currency manipulations/unilateral trade issues as between states o Private international law Deals with rights and responsibilities of private individuals or corporations (entities) operating in an international environment Multilateral trade agreements, bilateral investment treaties, private individual tries to make claim to broader global system Ex: Good product being sold to global market, a country seizes the store in their country, gets US to back him up (private int. law agreement) o What is the legal basis that the plaintiff is bringing the case on?
