Kathleen Basurto 4/19/2016 Business Law-2211-NET04 Instructor – Susan Horn Case 2.3 Standing to Sue Case Question 1) Does Michigan or Ohio law apply to this case? In this case, Michigan Law would apply. Even though all parties were residents of the state of Ohio, the accident occurred in the state of Michigan. The state of Michigan has a statute specific to snowmobilers stating that snowmobilers assume the risk. Since the state of Ohio has no statutes pertaining to snowmobilers, there is really no basis for a summary judgement in the state of Ohio. That being said, if suit were to be filed in Michigan, the defendants would be protected by the statute that is in place in that state. Case 2.7 Ethics Case Question 1) Does the Maryland court have personal jurisdiction over the Florida defendant? In this case, the Maryland court does have personal jurisdiction over the Florida defendant.

Based on the fact that there was clear intent by the defendant to do business in the state of Maryland, this allowed for the Long Arm statute to be extended to the ²lorida defendant. Ques±on 2) Did defendant Banks act ethically in this case? The defendant did not act ethically in this case. It is apparent that the defendant infringed on the trademarks that were registered to the plain±³, Chanel, Inc.
