Des Moines (1969) Precedent: Schools can’t prohibit students from expressing opinion unless it threatens substantially to disrupt school discipline or the rights of others. Will Jesse Doyle suspension withstand constitutional policy? No, in fact, the school has failed to provide and show serious levels of disruption. The school cannot prohibit students from expressing themselves in any manner. In effect, this has violated school policy in addition to Jesse Doyle’s constitutional First Amendments rights.

Norview Middle School has failed to show any clear evidence that school was getting disruptive beyond the powers of authority. As a result, It is Mr. Boyle’s protected right of speech and expression to have his hair dyed any color he chooses without any repercussions from school faculty....
