- Who does the law apply to? - Issues of access to justice and legal aid o Legal aid free legal advice or representation for a person who cannot afford it o Small claims court o Paralegals A person with specialized training who assists lawyers o Pro bono Done for the public good without compensation - What is legal aid? o A plan to provide legal services to persons who cannot pay full legal fees o Fees of lawyers reduced o Funded by gov’t fund, lawyer’s subsidies and client contribution - Models of Legal aid o Judicare private lawyers are the primary providers of the legal services Apply for legal aid Granted a certificate Present certificate to a lawyer from those registered with legal aid Lawyer agrees to rates for legal aid services Benefits Client gets to choose lawyer Criticisms Minimal funding o No money for full legal service by lawyer o Not all types of cases funded Structural problems not addressed o Legal services/Public Defender
