Allen can be charged with 2 counts of conspiracy to robbery, negligent homicide of Susie, and robbery of Bank of America, and attempted robbery of UFCU. TPC 15.01 (a)(1) states that a person commits criminal conspiracy if with the intent that a felony be committed, he agrees with one or more persons that they or one or more of them engage in conduct that would constitute the offense and he or one or more of them performs an overt act in pursuance of the conspiracy. Allen agreed with Billy in the Bank of America robbery and agreed with Big Joe in the UFCU robbery. The act of attaining a vehicle for both robberies was enough of an overt act to satisfy the overt act requirement. No valid defenses could be raised by Allen on these charges. He can be charged with the robbery of Bank of America because under TPC 7.02 a person is criminally responsible for an offense committed by the conduct of another if acting with intent to promote or assist, the commission of the offense he solicits, encourages, aids or attempts to aid the other person to commit the offense.
