Criminal Law –PO 332 Mark S. Sechrist Essay #1 February 17, 2008 Randy Street Controversial Law: Maternity Leave To solve social issues; the United States government along with state governments, have passed several laws by means of the legislature. These laws where proposed by the legislature or by a government institution because of a problem that someone felt strongly enough about to believe that a change needed to be made. One such law is the law proposed by the Ohio Civil Rights Commission ( ORCC), this past December. The law set up for businesses with four or more employees to provide mandatory either paid or unpaid maternity leave of 12 weeks to all employees (Niehaus, 2007). This law received a great deal of opposition by business owners and others and has flooded a number of the State’s officials’ inboxes with emails opposing the law (Niehaus, 2007). This Law is a great step for civil rights however and can be very detrimental to the economy of the state of Ohio. There are many arguments against the mandatory maternity leave law and others that have came before it; most recently “Business groups led by the National Federation of Independent Businesses have mobilized their members to oppose the rule. They cited the hardships that would be created by the additional time away from work, and the fact the rule would apply to all pregnant women, regardless of how long they had worked at the company” (Niehaus, 2007). This position caused Ted Strickland to consider the sides of the Ohio businesses in the economy he swore to improve and therefore he “asked the chairwoman of the ORCC, one of his appointees, to voluntarily remove the rule from the December 3 agenda to give businesses an opportunity to assess how they would be impacted by the new rules. She refused the request.” (Niehaus, 2007). The ORCC then later on went on to explain her refusal by clarifying the reason for the law to be proposed; “to clarify current Ohio law, which simply provides that employers of
