Presidents have committees that are formed by scholars, teachers, politicians, newspaper, etc. Tries to address the question “Is pornography harmful/in danger to people?” The conclusion was pornography is not harmful. The attitude is if you don’t like it then don’t watch it. Lecturer think’s it’s correct. 3. The Attorney General’s Report (1986) a. Regan committee. True about some porn but there is degrading porn that could be sensitive. Rape scenes in porn are old, consider a “classic.” Wanted to legally outlaw degrading porn because it will have led to bad acts. Lecturer questions what is sensitive and how do we pick out those movies? 4. Two Cases: Stanley v. Ga and Paris Adult Theater v. Slaton a. Stanley v. Ga ; Court says you are entitled to the first amendment in the privacy of your own home you can watch it. If you want to use porn, then your free speech right is obtained. (Liberal decision) b. Paris Adult Theater v. Slaton ; Contrasting decision. Maybe you should be able to use porn but the city/state can outlaw the sales and transaction of pornography. If you can’t buy it/rent it how do you watch it. Online streaming is available. You can’t shut down a site down. Have we been able to shut down terrorists sites? “Good luck trying to outlaw porn because we have rentals, porn houses, online streaming, etc. Slippery slope.” – Lecturer. 5. Mill: argues for nearly completely freedom of expression using, the utilitarian principle. The only legitimate restriction on speech is when it is used to incite violence – harm to others principle only. The immorality and paternalism principles do not work; offense principle questionable. a. We are going to have a problem when it comes to hate speech. Utilitarian principle.
