Business Law 2205 Tort Assignment 1. The federal government was the lone defendant when the bench trial opened (Federal Aviation Administration). Collins was initially blamed for “falling below the standard of care of a reasonable pilot” and not reporting his location to the tower correctly. The Air traffic controller was also a defendant until it was deemed ultimately the responsibility of the FAA. 2. The plaintiffs are the wifes/children/heirs of the deceased (Bob Collins, Herman Luscher, and Sharon Hock). As well as the hospital which was damaged. 3. This would be held in a state court because it is only regarding a federal agency not a federal question or constitutional question. This would bench trial held in civil court. 4. This is a bench trial before US District Judge John Darrah 5. I believe the plaintiff’s claim is an intentional tort. The plaintiff’s lawyers are trying to prove that the FAA knew of the consequences that are likely to occur if there is no radar. Although “the mistakenly left off FAA list” may be negligence
