PHIL 140 9.19.07 Death Penalty Furman vs. Georgia Furman said that if you execute me its cruel and unusual. Court said yes it is because its  arbitrarily administered.  Georgia wanted to allow the death penalty and make it so that its not arbitrarily (randomly)  administered.  Old Statutes (were unconstitutional): If you murder somebody, you  can  be sentenced to die.  New Statutes: If you murder somebody and ___aggravating circumstances     _____      , then you can  be sentenced to die.     Aggravating circumstance = if your victim was a child, lots of victims, if you killed someone while  committing another crime. Makes the murder a lot worse.  Decision made in 1976. 400 people have been executed in Texas. All states combined  executed less than 400. 25 people executed last year in Texas. There has been less than 25  executions since 1976 in all states!  Unconstitutional to execute someone who raped an adult, if they’re mentally retarded, and if a  minor.  What justifies punishment at all? Deterrence :  We are morally justified in punishing a person just in case (if and only if)  the punishment serves a deterrent purpose.   o What goods would be gained by punishing this person now. Good that will be  achieved in the future by punishing this person now.  o What is a deterrent purpose? Special: Prevent the specific person from committing the crime. The  punishment itself prevents its recipient from committing further crimes.  (Since he committed a crime, he has a high probability that he’ll do it  again and this will prevent him from doing that) General: Motivation supplied by the punishment to prevent other people  from committing the crime. The punishment motivates potential offenders
