Acharon City Councilor (President Pro Tempore) (O.B.)WHEREAS, Sub-paragraph (viii), Paragraph (4), Section 458 of RA7160, otherwise known as the “Local Government Code of 1991”explicitly vests to the Sangguniang Panlungsod concerned theauthority, among others, to provide for the impounding of astrayanimals within its territorial jurisdiction;WHEREAS, this Sangguniang Panglungsod finds it timely, proper and necessary toregulate the presence of astray animals within the City of General Santos as someconcerned organizations have already been conveying their desire for the enactment ofsuch legislative measure to safeguard the public from the dangers that may be broughtabout by incidental animal bites;
WHEREAS, the Office of the City Mayor, in its letter-request of September 3, 2001 tothis Sangguniang Panlungsod, has also cordially sought the enactment of an Ordinancethat will enable the constitution of General Santos City Pound purposely to deter theproliferation in the City of astray animals;NOW, THEREFORE, on motion of City Councilor Ramon R. Melliza, duly seconded byCity Councilors Lourdes F. Casabuena, Minda L. Atendido and Cesar B. Bañas, be it –RESOLVED, as it is hereby resolved, to enact this Ordinance:ORDINANCE NO. 05Series of 2001AN ORDINANCE PROHIBITING THE PRESENCE OF ASTRAY ANIMALS IN ALLPUBLIC PLACES WITHIN GENERAL SANTOS CITY, AUTHORIZING FOR THISPURPOSE THE ESTABLISHMENT OF GENERAL SANTOS CITY POUND AND THECOLLECTION OF FEES FOR THE USE THEREOF, AND FOR OTHER PURPOSES– – – – – – – – – – – – – – – – – – – – – – – – – – – – – – – – – – – – – – – – – – – – – – –Hon. This Ordinance shall be known as“The Anti-AstrayAnimal Ordinance of the City of General Santos.”Section 2. –Definition of Terms. As used in this Ordinance the following termsshall be understood to mean as:ASTRAY ANIMAL– any domesticated animal such as dogs, cattle, poultry,rabbits, horses, goats, carabaos, cows, cats, and the like without beingaccompanied by an owner or tamer at loose or elsewhere wandering in publicplaces within the city.
