1 THE POLITICS OF SELECTING FEDERAL COURT JUDGES This slide presentation will be posted after class at This slide presentation will be posted after class at http://www http://www -polisci.tamu.edu/faculty/flemming polisci.tamu.edu/faculty/flemming / Becket Fund Vows Immediate Appeal to Preserve Pledge Reaction Is Broadcast Nationwide Across All Media Washington, DC September 15, 2005 Yesterday afternoon, the U.S. District Court for the Eastern District of California ruled that reciting “under God” in the Pledge of Allegiance, even voluntarily, in public school is unconstitutional. The Court also signaled that it is willing to enter a restraining order prohibiting that recitation. The Becket Fund represents a group of defendant- intervenors as parties in the lawsuit: 10 California public school students and their parents, who want to protect their right to recite the full Pledge voluntarily, as well as the 1.7 million members of the Knights of Columbus, an organization that spearheaded the effort to add the phrase "under God" to the Pledge in 1954. Immediately, the Becket Fund saturated the media with its reaction: “To protect the right of every child in public school to recite the Pledge, we will immediately appeal this decision to the 9th Circuit,” declared Derek L. Gaubatz, Esq., Director of Litigation for The Becket Fund. “For generations, public school students have enjoyed the constitutional right to opt out of the Pledge if conscience dictates, and that’s as it should be,” said Anthony Picarello, President & General Counsel for The Becket Fund, “But Newdow’s suit goes a step farther – he’s seeking a court order that would prohibit students who want to say the complete Pledge from doing so. If you don’t want to say the Pledge then don’t, but don’t try to force your view of it on everyone else.”
