For each of the following scenarios, please describe (1) whether or not the employee has a possible wrongful discharge claim based solely on the facts presented, and (2) if there is a possible claim, whether it will most likely be based on violation of public policy, breach of an implied covenant of good faith and fair dealing, an implied contract, or tortious discharge theory. a. Employee is discharged in violation of procedures set forth in an employee handbook, which the employee was given when he accepted his job. - In this case I would think that the employee was at fault and that under the at will doctrine, this would fall under justifiable. I would not think a wrongful discharge case was possible. b. Employee is discharged for reporting to a government agency that there are unsafe radiation levels in the employer's plant. - In this case, I would think the employee should be protected under the whistle blower protection act. This would fall under wrongful discharge.
