Mallory Zaccone Poli. Sci. Writing Assignment #1 09/27/07 Dr. Archie-Hudson “Summons for Jury Service.” This is what is printed in large red letters across the official-looking envelope. A feeling of dread and frustration typically follows as you realize that, soon, your life will be intruded upon by the legal process. It is because of this attitude that only 46% of Americans summoned for jury duty show up. This statistic is unacceptable not only because it is causing a crisis in the ability of the state courts to set criminal and/or civil matters for a trial, but also because there is a constitutional obligation that citizens serve as jurors, which should be enforced by the states and that citizens should serve willingly. Under the Sixth and Seventh Amendments to the United States Constitution, “In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed” and “the right of trial by jury shall be preserved.” Given that the Constitution clearly states an individual’s right to a trial by a jury of his or her peers, it is the obligation of all citizens to serve as jurors to make the trial as just as possible. It is also clear through the Constitution that a jury is meant to protect the accused from possible bias on the part of the government or judge. As stated on the South Carolina state website, “The jury is given the right to scrutinize the facts of the case and even the law itself if it feels the law is unjust. The protection of our rights and
