Raymond Gonzalez 1 According to the Digital Millennium Copyright Act (DMCA) “No person shall circumvent a technological measure that effectively controls access to a work protected under this title” (17 U.S.C. 1201(a)(1)(A)). What this means is that any technology that can grant unauthorized access to copyright protected digital content is illegal. This law was implemented to help control the sharing of digital content that is sold on the internet to help protect the revenues of the companies that sell products over the internet. As of today it is uncertain of how effective the DMCA will be in protecting copyrighted work over the internet with regard to both the creators and the consumers of intellectual property. The DMCA was created to help protect the people that create intellectual property by “stopping people from breaching their contracts by interfering with the market for contract breaching tools” (Kerr 167). In other words the goal of the DMCA is to stop both the production and use of technological tools that can make copyrighted media free for everyone. At first sight the DMCA seems like a noble effort to protect copyrighted work from being illegally reproduced. The act attempts to take copyright law to the next level by making it illegal to even produce tools that can decrypt copyrighted material. The problem with outlawing “contract-breaching” technology is that people are arguing that it interferes with the right to free use. These people believe that they should be able to do what they want with rightfully purchased media; “It’s time that we took that act of faith
