This decision stifles innovation in the industry by allowing the cable carriers to be the sole service carrier. The “common carrier” rule that affects the telecommunication industry where the owner had to provide open access to any network does not pertain to the cable industry under the idea that they are using a “data transmission” network. “Data transmission” networks do not follow the same rules as the telecommunication industry even though there is telecommunication happening over the data network.
