KEY TERMS Stare decisis o “let stand the precedent” Liberalism o The view that the main function of the legal system is to secure basic rights and freedoms to citizens and establish a zone within which each individual may choose what is “good” Ratio decidendi o The reasoning behind a certain decision Crime o Any social harm defined and made punishable by law Privity of Contract o The relationship that exists between two or more parties to an agreement. Delicts o Wrongs or crimes Negligence o Conduct that falls below the standards of behavior established by law for the protection of others against unreasonable risk of harm Liability o Legal responsibility for one’s acts or omissions Sanctions o punishments Imminent danger o Actus Reus / Mens Rea o Judgment proof o Guy without money is “judgement proof.” Aka: even if he is found guilty, he still can’t be punished because he can’t afford to pay a fine.
