16/11/2007 09:46:00 Jury Selection A master list of potential jurors is compiled A random subset of potential jurors is called Voir dire Both prosecutor and defense lawyer each get a certain amount of peremptory  challenges- you don’t need a reason to exclude that juror. o Implicit personality theories and stereotypes. o Scientific Jury Selection  Involves having hired professionals from  which the jurors will be drawn and survey people. Ask two types of  question: 1) Age, Occupation, Etc. 2) Opinion on trial relevant questions Criticism: Poor cannot afford it, only the rich can. Some people  want elimination of peremptory challenges. o Death Qualification Capital cases- Jurors decide whether or not they put them to  death. If someone is found guilty and you go to second phase of  deliberations. People who favor death penalty are more likely to convict  and sympathize for prosecutors. Also been suggested that by asking that question jurors  are essentially being primed.  Confession Evidence Interrogation tactics o Prisoner’s Dilemma  o Good Cop v. Bad Cop Befriend the suspect (positive coercion bias) Sympathize with them Offer leniency Make them feel safe and like you’re on their side
